INDIANAPOLIS -- As cars head to the track for opening practice at Indianapolis Motor Speedway, NASCAR received word Friday that the 4th Circuit Court of Appeals has sided with the sanctioning body and upheld its suspension of Sprint Cup driver Jeremy Mayfield.Mayfield, who has now tested positive for drug use in two separate tests conducted by NASCAR, was originally suspended on May 9. But earlier this month he won an injunction which lifted the suspension and allowed him to race.
He did not enter a race while the suspension was lifted, and failed a second drug test last week.
"We are pleased with the 4th Circuit Court's ruling to reinstate NASCAR's suspension of Jeremy Mayfield," NASCAR spokesman Ramsey Poston said in a statement. "This is an important decision for NASCAR to make fair and equitable regulations for the safety of competitors and spectators at the track. We will continue to respectfully make our case for as long as the litigation continues."
Mayfield is in the process of selling his team and the lone remaining employee resigned last week. Mayfield, told NASCAR.com earlier this week that he has a potential sponsorship deal and hopes to drive for another team. He has repeatedly denied using drugs. NASCAR says the positive tests indicated methamphetamine use. Mayfield claims they have been false positives, reacting to his use of a prescription medication for ADHD (Attention Deficit Hyperactivity Disorder).

ok.. i dont know if i should respond to this posting or correct all the spelling and gramatical mistakes.
i lost my job due to a false positive which the courts had reversed. the test told me i tested positive for meth... i dont even know what meth is and i sure as hell dont know anyone who would know anything about it either. the doc took me off the stuff i was taking, and 21 days later tested negative for meth. theyre going to test more often from now on with me, but its understood. what would concern me is if he WASNT fighting this.

Another false positive story; at a local temp aganecy my Husband tested positive for meth which neither of us had ever tried but having worked at a methadome clinic I know for a fact consumers look gray, very thin and are covered in facial sores. Mu Husband was a fat, clear skinned 327 pounds at the time. Turns out the day he was tested, some exterminator had sparyed for bugs-including the counter to where the urine was sat then tested via ph strip. If this man is innocent too-a blood test will prove it.

Obviously most people have no idea what meth does to someone and there is no way that Jeremy Mayfield was using meth. Take it from the mother of a recovered meth addict. If Jeremy was taking meth he would in no way be able to function as a driver in NASCAR.

Cindy Williams....you should stick with Laverne and Shirley and leave NASCAR to us guys. NASCAR wasn't out to get Mayfield. He's a meth head and doesn't need to be behind the wheel on a 3500 lb. car with 42 other drivers on the track...maybe youneed to back away from the crack pipe as well...just sayin'

Wow. Yet ANOTHER sexist pig who thinks some toys are just for boys. Men like you make me SICK!! Let me guess, you sit around all day scratching your ass and farting, don't you. I'd like to see you tell Danica Patrick that racing ain't for girls. She makes more in a month than you do in two years.
Did your mommy not hug you enough as a child?

I here everybody talk about how he shoudn't be driving cause hes a meth head, And yes he tested positive twice i'll accept that, But was his driving actually any worse than others on the track? I don't think it interfered with his performance at all and yes you can test false positive for meth if you take a combination of certain drugs, as has been proven. Do i like mayfield not really do i think he is getting a bum rap? maybe? I think it should be looked into much more than is being done, After all do you honestly think mayfield would keep doing meth to be tested positive again a second time? I think there is more to this story than anyone knows!

Mark Martin said he wouldn't object to Mayfield racing but Jeff Burton is full of fear. If Burton is so afraid then maybe he should just leave racing. After all, he hasnt done squat in years except to kiss NASCAR'S ass.

I use to work in NASCAR and when you get them mad they will get you one day. It seemed like they were picking on Martin in Chicago with all the "debris cautions". I guess because he said he didn't mind racing with Mayfield. I hope Mayfield stays with the legal stuff. I just wonder if he will keep the name NASCAR when he wins the civil suit and owns them.

I do NOT trust Nascar's physicians. I used to be involved in drug testing in the electrical industry, and know for a fact there are MANY ways for a false positive to come back. The court should only consider totaly independant test labs for results. To continue to use Nascar test company removes any possibility of an unbiased result. Mr. Mayfield should consider having tests done at multiple injdependant facilities, as well as a few hospitals, who are plenty well equiped for it. Then, after multiple clean test come back, sue Nascar for all they are worth for defamation of character, and slander, for starters.
